Michael Kuzma: Lawyer, New York State Senate Candidate

Get to know a Buffalonian…

For years, Mike Kuzma has worked in, and sometimes rallied against, City Hall in Buffalo, NY. If you’re tired of politicians whose positions seem to change with the wind, you may find his views refreshing. He recently announced his candidacy for the District 58 State Senate seat currently held by Bill Stachowski, who has served in local and state politics since 1974.

Why do you think so many people get so mad at City Hall, year after year?

It takes so long to get anything done. Whether it’s getting a derelict property torn down, having a street repaved, or a sidewalk replaced—it seems to take forever. As a result, people get frustrated, give up and vote with their feet by moving out of the city. This is the primary reason why the population of Buffalo is now less than half of what it was in 1958.

Most people have no idea who Leonard Peltier is. Why don’t they and why should they?

Leonard Peltier is a Native American, who is currently incarcerated at the United States Penitentiary in Lewisburg, Pennsylvania for the shooting of two FBI agents at the Pine Ridge Reservation in South Dakota on June 26, 1975. February 6, 2010 will mark his 34th year of imprisonment in spite of the fact that one of the prosecutors in his case has publicly stated that the government does not know who shot the two agents. Leonard was a member of the American Indian Movement (AIM). AIM was targeted by FBI under COINTELPRO, which was nothing more than a dirty tricks program directed against political activists on both the right and the left. Leonard is viewed by Amnesty International, South African Bishop Tutu, folk singer Pete Seeger, fashion designer Vivienne Westwood, and others as being a political prisoner. Since 2001, I’ve been fighting to pry loose documents from the government under the Freedom of Information Act (FOIA) relating to the case. When Leonard was tried in 1977 the prosecution merely turned over 3,500 pages of material pertaining to the case to Leonard’s attorneys. As a result of the many FOIA requests we’ve submitted, we now know there are 142,579 pages of FBI documents concerning the case. The government, to this very day, refuses to turn over these 30 plus year old documents on National Security and other grounds. How can anyone say Leonard received a fair trial in light of the fact that the prosecution has, and continues to withhold thousands and thousands of pages from defense attorneys?

What’s the best way to spend Dyngus Day?

I like to stand on Fillmore Avenue at Paderewski with friends and watch the Dyngus Day parade. Afterwards, stops at the Central Terminal, Three Deuces at 222 Gibson Street, and Mickiewicz Hall on Fillmore Avenue are mandatory.

Sean Penn is generally recognized as one of the greatest actors of his generation. You’ve met him. Why do you think he bothers to get mixed up in politics?

Two years ago some friends and I met Sean Penn, Congressman Dennis J. Kucinich and his wife, Elizabeth, at the House of Blues in downtown Cleveland. I believe Sean Penn is using his celebrity status to put the public spotlight on important issues such as ending the war in Iraq and the inhumane blockade against Cuba, and that’s a good thing.

What can we expect to change when you’re elected to the New York State Senate?

I will address issues head on. You will never have to wonder where I stand on the issues. Among other things, I guarantee that I will remain steadfast in my support for same sex marriage, medical marijuana, term limits, end of the wars in Afghanistan and Iraq and the immediate return of New York National Guard from Afghanistan and Iraq, strengthening the Freedom of Information Law, honoring Indian Treaties, including, but not limited to, the Treaty of 1842 with the Seneca Nation of Indians.

Mr. Kuzma is a consummate liar when it comes to the Peltier murder case. If you want proof, read the book American Indian Mafia and see how, for over 30 years, Left-leaning lawyers have assisted an unrepentant “cop killer” in defrauding the public using a manufactured persona as “political prisoner” and a tax-exempt defense fund that must falsify the legal record in order to extract sympathy dollars. American Indian Mafia exposes Peltier’s well-rehearsed alibis and leaves no doubt about his guilt in the cold-blooded murders of two FBI Agents in 1975. After reading this book, you will find it difficult to take Mr. Kuzma seriously on any topic.

Mr. Simon, there have been many books written & videos made regarding Leonards guilt or innocemce. Since we were NOT there, we can only form an opinion about him from what others say! I choose to believe he was set up. I quote Francis Bacon:

Ask Mr. Simon and Mr. Trimbach about Frank DeLuca aka Frank Blackhorse, who was arrested with Leonard Peltier on February 6, 1976, and remains a free man in Canada to this very day! The firefight on June 26, 1975 is a classic example of COINTELPRO gone awry.

SA Curtis Fitzgerald is shot by a militant who fired from the rear of a stolen U-Haul van. American Indian Mafia, p. 512. SA Fitzgerald’s wound was permanently disabling. Aerican Indian Mafia, p. 135. The so-called “militant” who shot SA Fitzgerald was Frank Blackhorse. In spite of this fact, Mr. Trimbach never references Mr. Blackhorse in his book. Charges against Mr. Blackhorse for wounding SA Fitzgerald were withdrawn by the government on August 2, 1978. It should also be noted that Blackhorse was sought for shooting FBI SA Agents Coler and Williams at Pine Ridge on June 26, 1975. In fact, a July 17, 1975 teletype from FBI Rapid City to the Director and several other FBI field offices indicated that the investigation of this case is being directed towards: ” . . . develop[ing] information to lock Peltier and Black Horse into this case.” Nevertheless, Blackhorse has remained free in Canada for over three decades. Why is it that a man who wounded a FBI SA Agent and was sought in connection for the death of two others has never been extradited back to the United States? Perhaps Mr. Trimbach and/or Mr. Simon can offer an explanation for that.

Thank you Mr. Kuzma for all the work you do. Yes, Trimbach and the FBI have a lot of questions to answer. There is a new foia document uncovered by journalist Steve Hendricks. It states that Anna Mae was sighted on February 12, 1976. She was seen ALIVE exactly two months after the fbi says that AIM killed her. They will not release the name of the “informant” that saw her. There is much that the fbi needs to come clean on about Leonard and Anna Mae.

Utter nonsense. All the questions you want answered are in the book and on the web site, americanindianmafia.com. As Mr. Kuzma well knows, the courts have visited all of these issues repeatedly and have dismantled all of Kuzma’s theories about Peltier’s alibis and fables. As for Steve Hendricks, Mafia exposes this self-described “investigative journalist” as a political hack who is stuck defending a book (his) full of innuendo, conjecture, and falsified research.

Ask Mr. Kuzma if inmate Peltier has any remorse for interrogating murder victim Anna Mae Aquash by putting a loaded gun in her mouth a few months before Peltier’s crime bosses ordered her execution in 1975. Perhaps Leonard sealed her fate as a falsely accused government informant after he bragged to her and others about shooting Agent Ron Williams in the face at point-blank range as he pleaded for his life. Peltier certainly shows no remorse for that murder; Ron died with his right hand in front of his face to ward off the blast from Peltier’s AR-15, fired close enough to leave powder burns on Ron’s fingers. All of this can be found in American Indian Mafia and the legal record, the only account that matters where unrepentant double murderers are concerned. Also ask Mr. Kuzma why Peltier’s former attorney, Barry Bachrach, no longer believes in Peltier’s innocence. Peltier’s 1993 Parole board said it best:

“Although the above evidence is consistent with your having, while at the scene of the murders, aided and abetted the use of the above-mentioned AR-15 rifle by another individual to execute the agents, the Commission is persuaded that the greater probability is that you yourself fired the fatal shots… It would be unjust to treat the slaying of these F.B.I. agents, while they lay wounded and helpless, as if your actions had been part of a gun battle. Neither the state of relations between Native American militants and law enforcement at the Pine Ridge Indian Reservation prior to June 26, 1975, nor the exchanges of gunfire between individuals at the Jumping Bull Compound and the law enforcement agents who arrived there during the hours after Agents Coler and Williams were murdered, explains or mitigates the crimes you committed… Your release on parole would promote disrespect for the law in contravention of 18 U.S.C….”

“Much of the government’s behavior at the Pine Ridge Reservation and in its prosecution of Mr. Peltier is to be condemned. The government withheld evidence. It intimidated witnesses. These facts are not disputed.” Peltier v. Booker, 348 F. 3d 888, 896 (10th Cir. 2003).

” . . . there is evidence in this record of improper conduct on the part of some FBI agents . . .” United States v. Peltier, 800 F. 2d 772, 778 (8th Cir. 1986).

“The use of the affidavits of Myrtle Poor Bear in the extradition proceeding was, to say the least, a clear abuse of the investigative process by the FBI. This was conceded by government counsel on the hearing in this court.” United States v. Peltier, 585 F. 2d 314, 335 fn. 18 (8th Cir. 1978).

By the way, why won’t Mr. Simon and/or Mr. Trimbach even mention Frank Blackhorse, who was arrested with Leonard Peltier on February 6, 1976? Could it be that he was an agent provocateur sent in by the FBI to disrupt the American Indian Movement (AIM)? Their silence on this issue speaks volumes. No, Carol, but thanks for the compliment. I have talked to people familiar with the case and I have read the Trimbachs’ book but I was not there but have come to the conclusion that Peltier is unquestionably guilty. To believe otherwise is illogical based on the evidence against him which is simply overwhelming. I’ve also found that Peltier’s supporters are, by and large, guided by doctrinaire beliefs that fit their political template, nothing more. Guided by the rhetoric from the likes of Mr. Kuzma, they prefer to believe that hundreds of people joined forces in a massive conspiracy to deny Leonard his rights out of some sort of deep-seated animosity toward Native Americans. The people Mr. Kuzma seeks to demonize are, by the way, the same people who have spent much of their careers trying to help Native Americans. Always thought it curious; Peltier’s defenders appear unaware of the lifetime of hell he visited upon his victims’ families. Just as despicable, Mr. Kuzma never mentions the eight findings of fact as determined by the Court of Appeals which place Peltier at the murder scene with weapon in hand at the critical moment. This Blackhorse fellow was nowhere near the murder scene according to Kuzma’s bible, In the Spirit of Crazy Horse. Mr. Kuzma also forgets to mention the context in which he summons his paltry Peltier defense, e.g. the US Court of Appeals decision, No. 85-5192, 800 F.2d 772, 778, 1986. Here’s the entire paragraph he does not want you to see:

“When all is said and done, however, a few simple but very important facts remain. The casing introduced into evidence had in fact been extracted from the Wichita AR-15. This point was not disputed; although the defense had its own ballistics expert, it offered no contrary evidence. Peltier raises general questions regarding the handling and examination of the.223 casing and the Wichita AR-15, but does not make specific allegations of tampering. There are only two alternatives, however, to the government’s contention that {F.2d 778} the.223 casing was ejected into the trunk of Coler’s car when the Wichita AR-15 was fired at the agents. One alternative is that the .223 casing was planted in the trunk of Coler’s car either before its discovery by investigating agents or by the agents who reported its discovery. The other alternative is that a non-matching casing was originally found in the trunk and sent to the FBI laboratory, only to be replaced by a matching casing when the importance of a match with the Wichita AR-15 became evident. We are not convinced that either alternative is likely. The discovery of a.223 casing in the trunk of Coler’s car was documented in a contemporaneous report. That report listed dozens of other items that were found in Coler’s car on the same date. The detailed nature of that report makes it highly unlikely that it was fabricated. Not only is there no direct evidence that the .223 casing found in the trunk was replaced by another casing, the internal operating procedures of the FBI with respect to the preservation of evidence makes it unlikely that such replacement could occur without massive collusion. We recognize that there is evidence in this record of improper conduct on the part of some FBI agents, but we are reluctant to impute even further improprieties to them.”

There’s also this missing conclusion from Kuzma’s cited Appeals court ruling in US v Peltier 585 F.2d, 1978:

“The two witnesses testified outside the presence of the jury that after their testimony at trial, they had been threatened by Peltier himself that if they did not return to court and testify that their earlier testimony had been induced by F.B.I. threats, their lives would be in danger.”

These findings jive with Peltier’s murderous tendencies and his boast about shooting FBI Special Agent Ron Williams in the face, a boast heard by four witnesses and publicly proclaimed by two of them: “The motherf—ker was begging for his life but I shot him anyway.”

In short, Carol, Mr. Kuzma appears less interested in presenting the truth about his client than in furthering a political agenda that only results in tormenting the families of Peltier’s victims. Given his politics and his statements, I do not see why District 58 voters would support his candidacy and grant him the public trust.

Amazing how so much conjecture surrounding the Leonard Peltier case is purported to be the truth by people who presume to know so much about it. Where is the evidence for all these ‘facts’? Isn’t it a fact that Evan Hodge, the ballistics expert who had examined the shell casings alleged to have been fired from Peltier’s AR-15 rifle, testified at trial that they did match the gun? Isn’t it also a fact that his written report, which was witheld from the jury at the time and subsequently obtained under the FOIA, clearly states that the casings in question could NOT have been fired by Peltier’s gun? The report further states that the more precise firing pin test had also been carried out which conclusively established that fact.

It is also a fact that I watched Canadian documentary ‘The Fifth Estate’ where the investigator showed Mr Hodge a copy of his original report which he had contradicted in his perjured testimony at trial, and he stated “No-one told me it was an important case”.

Peltier has never denied being at the Jumping Bull ranch during the shootout when the FBI agents and Native Joe Stuntz were killed, but there is no evidence to prove that he was the person who murdered the agents in cold blood; only proven fabrication which everyone chooses to ignore.

If you were there that day you would know the Agents were placed in a ritualisitic ceremonial position, so that there souls would return to the Earth. Leonard Peltier is a cold blooded unrepentant murderer, who also had a hand in the premeditated murder of Anna Mae Aquash, ordered by AIM hiarchy via John Graham, Peltier bragged to Aquash about murdering the 2 young FBI agents..while they begged for their lives already mortally wounded….does that sound like a political prisoner or a murderer…
What if it were your children, or brother, or Father…like Ray Robinson, another AIM murder victim, eh..allowed to bleed to death in the AIM infrimary during the Seige of WK, shot by AIM for not shooting back at the FBI…his remains hidden as they remain today.
